What is the right to be forgotten?

The right to be forgotten, also known as the right to erasure, is the right the General Data Protection Regulation (GDPR) gives individuals to ask organizations to delete their personal data.

However, in certain cases this right to be forgotten is not applicable, and an organization has the right to process someone’s data, overriding that person’s right to be forgotten. Here are some reasons in which the General Data Protection Regulation gives the right to the organization to maintain someone’s personal data:

• The personal data is still necessary in relation to the purposes for which they were collected or processed;
• The data is being used to exercise the right of freedom of expression and information.
• The data is being used to comply with a legal ruling or obligation.
• The data being processed is necessary for public health purposes and serves in the public interest.
• The data being processed is necessary to perform preventative or occupational medicine.
• The data represents important information that serves the public interest, scientific research, historical research, or statistical purposes and where erasure of the data would likely to impair or halt progress towards the achievement that was the goal of the processing.
• The data is being used for the establishment of a legal defense or in the exercise of other legal claims.

As long as the data we collected from you is not anonymized or belonging to one of the exceptions mentioned in the text above, you are entitled to request us to erase any personal data we hold about you under European Union General Data Protection Regulation (GDPR).

To do that you must send a message to our Data Protection Officer identifying:

• when your data was collected;
• for what propose your data was collected;
• what type of data was collected;
• your name.

In the general situation, this is enough for us to identify and delete your personal data.

However, in some situations it will be necessary to request a proof identity for us to be able to delete your personal not anonymized information.
